The employer did not require the employee working on the ground beneath the roofer to wear a hard hat. The employee was exposed to a struck-by hazard.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   The employer did not ensure the employees performing roofing operations on the 8/12 pitch roof were protected from falling. Employees were exposed to a fall hazard of approximately eleven (11) feet from eave to ground.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access.  The employer did not ensure that the ladder extended more than one rung (approximately 1.5 feet) above the eave of the roof. Employees were exposed to a fall hazard of up to approximately eleven (11) feet to the ground.
