Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or are likely to cause death or serious physical harm to his employees, in that his employees were exposed to fall hazards: This violation was observed on or about August 12, 2014, where at least two (2) employees, who were engaged in tree trimming and one employee used the top cap and top step of fiberglass stepladders, and were exposed to falls of approximately 16 feet to the concrete below.

29 CFR 1910.135(a)(1): The employer did not ensure that each affected employee wore a protective helmet when working in areas where there was a potential for injury to the head from falling objects. This violation was observed on or about August 12, 2014, where at least 5 (5) employees, who were standing below employees trimming a tree were exposed to falling objects, and were not protected from head injuries by wearing hard hats.
