29 CFR 1910.178(l)(4)(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not provided to the operator when the operator has been involved in an accident or near-miss incident: Rosenthal Foods Corporation dba Greenburg Fruit Company 9705 I Street, Ralston, NE 68127: The employer is failing to ensure that forklift operators receive refresher training when they are involved in an accident and/or near-miss while operating a forklift. On or about 7/20/2014 an employee of the company was struck by another employee operating a Toyota Forklift Model# 7FBEU15 Serial# 16248. The forklift operator was entering the area, through an overhead door partition, the pedestrian was on the other side of the partition and tripped on the forks of the forklift and was sub sequentially struck. Retraining had not been conducted until 8-14-14 during which the operator continued to operator forklifts at the establishment.
