Delaware and W Tupper Avenues - On or about 8/15/14, an employee was observed operating a powered industrial truck, after lifting saw-cut sidewalks.  The employee was observed operating the forklift with forks raised; did not sound his horn at locations where vision was obstructed, such as when entering traffic; and, traveling at excessive speed. 29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)  a) NE Corner of Delaware and W Tupper Streets, on or about 8/15/14, employees are exposed to silica containing dust while performing dry saw cutting of concrete.  The employer has not developed, implemented, and/or maintained at the workplace a written hazard communication program which describes how the criteria specific in (f, (g), and (h) will be met.   A written program should include descriptions of the criteria for:      1.) Labeling and other forms of warning;     2.) Safety data Sheets, AND;     3.) Employee information and Training will be met.  Additionally, a list of hazardous chemical know to be present in the workplace must be compiled.  methods used to inform employees of the hazards associated with non-routine task and the informing of contractors of workplace hazard must also be addressed. An employee was observed using a Stihl saw to cut the concrete without any eye protection.  b.)  NE Corner Delaware and W Tupper - On or about 8/15/14, employees observed dry saw cutting concrete were not wearing eye and face protection that met the requirements specified in Z 87.1-1968.  An employee was observed using a Stihl saw to cut the concrete with non-ANSI-approved sunglasses.  c.)  NE Corner Delaware and W Tupper - On or about 8/15/14, employees observed dry saw cutting concrete were not wearing eye and face protection that met the requirements specified in Z 87.1-1968.  An employee was observed using a Stihl saw to cut the concrete with non-ANSI-approved glasses without side shield protection.  ABATEMENT CERTIFICATION REQUIRED
