OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to overhead hoists that were equipped with defective safety latches: a) Consolidated Container Company / 221 Grove Street, New Castle, PA: On or about August 15, 2014 --- employees were exposed to struck-by hazards from accidental load disengagement due to hooks with damaged latches that prevented them from closing. The hook associated with a Dayton 300 (p/n 473588) electric chain hoist model 3KR20 had a damaged safety latch and spring.

29 CFR 1910.1200(h)(3)(iv): The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information: a) Consolidated Container Company / 221 Grove Street, New Castle, PA: On or about August 15, 2014 the company did not complete GHS 2012 training prior to the December 1, 2013 deadline. Employees worked around and/or with chemicals that included but were not limited to white lithium grease, simple green, Loctite lubricants, etc.
