29 CFR 1910.23(e)(1): The railing did not consist of top rail, intermediate rail, and posts, and did not have a vertical height of 42 inches nominal from upper surface of top rail to floor, platform, runway, or ramp level:     a)   Employees were exposed to falls of greater than 4 feet while accessing the walkway along  the top of the 8 fermenter tanks.  The employer had not installed a complete  standard railing (or the equivalent) to protect employees from falls, the mid rail was missing.

29 CFR 1910.23(e)(3)(v)(b): Railing construction type, size and/or arrangement did not meet the minimum requirement of strength to withstand at least 200 pounds top rail pressure:    a)   Employees were exposed to falls of greater than 4 feet while accessing the walkway along  the top of the 8 fermenter tanks.  The top chain component was connected to the post with carabiner rated at 150 pounds.   Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

A several inch open space existed between the cover perimeter and the panel box frame.
