changed from 29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: to 1926.651(k)(1) A. L. D'Agostini & Sons, Inc. worksite located at the intersection of Miami St. & Oakdale, Toledo, Ohio: On or about August 15, 2014, the employer did not ensure employees were adequately protected from cave-ins while removing an existing pipe casing from below the road grade. The East wall of the trench was near vertical composed of "B" soil with a depth of approximately 7.00 feet deep.
