29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment: (a) Boat dock: On or about August 13, 2014 and times prior thereto, the employer did not require employees to wear personal flotation devices when line handling for launching or recovering the tourist vessels. This exposed employees to potential hypothermia hazard if they were pulled into the water.
