OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to severe lacerations and burns from explosions: a) Site - Rifle & Pistol Ranges - On or about 08/18/14, and at times prior thereto, employees were exposed to severe lacerations and burns from explosions when using a non-explosion proof vacuum, Nacecare NDD 900 Hepa Vacuum, Serial # 122101724, to vacuum up gun powder residue.

29 CFR 1910.134(a)(2): The employer did not establish and maintain a respiratory protection program which included the requirements outlined in 29 CFR 1910.134(c): (a) For employees cleaning at the rifle/gun ranges located at 116 East Fletcher Ave., Tampa, FL 33142 as observed on or about 08-18-2014. Employees were mandated to use a MSA full face single cartridge respirator without a respiratory protection program being in place. Some of the items covered under the respiratory protection program are but are not limited to that employees did not receive are: procedures for selection of respirators, medical evaluation, fit testing, and training on the use of the respirators by the employer, exposing employees to improper use of respirators, and potential medical complications.
