29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that that the approximate 108 inch by 76 inch excavation opening (at the base) by 82 inch depth on the southwest corner and 69 inch depth on the northwest corner had not met all the elements of sloping/benching options (2), (3), (4): a. The excavation at the First Baptist Church, East Main and Highway 50, on August 18, 2014, where a water line was repaired was not protected by either a protective system (such as a trench box) or sloping that met the requirements of the standard. (Note: the soil type was not classified by the employer.)
