29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: a) On or about 8/15/14 at the Thistle Apartments located at 85 Seneca Parkway, Rochester, New York; employees were replacing shingles on the roof of an apartment building with a roof pitch of approximately 12 in 12 and eave heights of approximately 20 feet. Fall protection was not in use in all work areas. ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: a) On or about 8/15/14 at the Thistle Apartments located at 85 Seneca Parkway, Rochester, New York; employees were replacing shingles on the roof of an apartment building. The employees were using a step ladder that was placed on a porch roof to access the upper roof. The ladder only extended 18" above the eave of the roof. ABATEMENT CERTIFICATION REQUIRED
