29 CFR 1910.1001(d)(2)(i): Each employer did not perform initial monitoring of employees who were, or could reasonably be expected to be exposed to airborne concentrations at or above the action level and/or excursion limits: a) Ackerman located in Curtice, Ohio; On or about August 13, 2014 the employer failed to conduct monitoring of employees who were exposed to class II asbestos work during the repair of the warehouse roof by M.J. Weis Roofing Co., LTD. Employees were exposed to hazards from asbestos, including asbestosis and lung cancer. Laboratory analysis indicated the material contained 29% chrysotile asbestos.

29 CFR 1910.1001(j)(1)(iii): Employers did not include asbestos in the hazard communication program established to comply with the HCS (� 1910.1200). Employers did not ensure that each employee has access to labels on containers of asbestos and to safety data sheets, and is trained in accordance with the requirements of HCS and paragraph (j)(7) of this section. a) Ackerman located in Curtice, Ohio; On or about August 13, 2014 the employer failed to include asbestos in the hazard communication program. Employees were exposed to asbestos during class II asbestos work on the warehouse roof by M.J. Weis Roofing Co., LTD. Employees were not trained on the hazards associated with asbestos exposure and protective measures. Laboratory analysis indicated the material contained 29% chrysotile asbestos.

Employees were not made aware of the presence and location of asbestos containing material during class II asbestos work on the warehouse roof. b) On or about August 13, 2014 the employer failed to determine the presence, location and quantity of asbestos containing material located within the building. M.J. Weis Roofing Company was not made aware of the presence and location of asbestos containing material during class II asbestos work on the warehouse roof.
