29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  (Note:  As referenced by the note contained in 1926.602(d)):    (a)Lesh Drilling at 113 S. Highway 85, Ault, CO 80610:  On and before August 19th, 2014, the employer did not ensure that each forklift operator was trained and certified to operate the Yale forklift, model GLP960ZGNGAE097, serial number AB75B137674. The conditions exposed employees to struck-by hazards.    Abatement Note: The requirements applicable to construction work under this paragraph are identical to those set forth at 1910.178(l).

29 CFR 1910.1200(h)(1): The employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area:   (a)Lesh Drilling at 113 S. Highway 85, Ault, CO 80610: On and before August 19th, 2014, the employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area such as but not limited to chlorine. (Note:  As referenced by the note contained in 1926.59):    Abatement Note:     (a)Employees shall be informed of:     (1)Any operation in their work area where hazardous chemicals are present; and,     (2)The location and availability of the written hazard communication program, including the required list(s) of hazardous chemicals, and material safety data sheets required by this section.     (b)Employee training shall include at least:     (1)Methods and observations that may be used to detect the presence or release of a hazardous chemical in the work area (such as monitoring conducted by the employer, continuous monitoring devices, visual appearance or odor of hazardous chemicals when being released, etc.);     (2)The physical and health hazards of the chemicals in the work area;     (3)The measures employees can take to protect themselves from these hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to be used;     (4)The details of the hazardous communication program developed by the employer, including an explanation of the labeling system and the material safety data sheet, and how employees can obtain and use the appropriate hazard information.

29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition when it was necessary by reason of the hazards of the processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact:    (a)Lesh Drilling at 113 S. Highway 85, Ault, CO 80610:  On and before August 19th, 2014, the employer did not provide and require the following personal protective equipment which was necessary for the employees to safely work in the following circumstances:    1)  While working on and around the derricks:  gloves, safety glasses, safety shoes, and hard hats;    2)  While working more than 6 feet high on a vertical derrick: a retractable lanyard with a full body harness;    3)  While handling materials such as pipe:  gloves, safety glasses, safety shoes, and hard hat;    4)  While handling equipment such as pumps:  gloves, safety glasses, safety shoes, and hard hat; and    5)  While handling chlorine and other corrosive chemicals:  an air-purifying regulator, splash proof goggles, a face shield, chemical-resistant gloves, and protection from skin exposure such as an apron.    Conditions exposed employees to fall hazards, eye injuries, foot injuries, concussions, skin abrasions, and chemical hazards.

29 CFR 1926.405(j)(1)(i): Fixtures, lampholders, lamps, rosettes, or receptacles had live parts normally exposed to employee contact, and were not located at least 8 feet above the floor:    (a)Lesh Drilling at 113 S. Highway 85, Ault, CO 80610:  On and before August 19th, 2014, the employer allowed the use of a light fixture in the walkway of the shop with an unprotected lamp that measured approximately 71 inches from the floor.  The conditions exposed employees to cut hazards and 120 volt electrical shock hazards.
