In accordance with 29 CFR 1903.19(c), abatement certification is not required for this violation

29 CFR 1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system.    a) West side of residence, 1 Erin Drive, Danville, PA - An employee engaged in repairing and shingling a steep sloped roof (14:12 pitch) of a residence was working at a height greater than ten-foot (>10') above ground level on a ladder jack scaffold without a personal fall arrest system. The employee was exposed to a fall hazard due to the lack of a personal fall arrest system, as observed on or about August 20, 2014.    In accordance with 29 CFR 1903.19(c), abatement certification is not required for this violation.

29 CFR 1926.451(c)(2): Supported scaffold poles, legs, posts, frames, or uprights did not bear on base plates, mud sills or other adequate firm foundation:  a) West side of residence, 1 Erin Drive, Danville, PA - An employee engaged in repairing and shingling the steep sloped roof (14:12 pitch) of a residence was working on a ladder jack scaffold with a component fiberglass extension ladder that was placed on uneven ground, whose left support was placed on two (2) stacked 2"x4" pieces of lumber, and whose right support had settled into soil. The employee was exposed to a fall hazard that ranged between eighteen-foot, three-inches to nineteen-foot (19') above ground level by ladder supports that were not placed on a firm foundation, as observed on or about August 20, 2014.  In accordance with 29 CFR 1903.19(c), abatement certification is not required for this violation.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access      a) North side, Residence: - Employees accessed the residence roof and/or a ladder jack scaffold using a twenty eight-foot (28') aluminum extension ladder that extended two-foot (2') above the edge of the roof and ladder jack scaffold. Employees were exposed to a nineteen-foot (19') fall hazard, on or about August 20, 2014.    In accordance with 29 CFR 1903.19(c), abatement certification is not required for this violation. Abatement was observed during the inspection.

29 CFR 1926.501(b)(13): Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:    a) Roof, Residence, 1 Erin Drive, Danville, PA - Employees engaged in repairing and shingling the steep sloped and low sloped portions of a residence roof worked were not protected from falling by guardrail systems, safety net systems or personal fall arrest systems. The employees were exposed to a fall hazard that ranged from ten-foot (10') to thirty four-foot, seven inches above ground level as observed, on or about August 20, 2014.    In accordance with 29 CFR 1903.19(c), abatement certification is not required for this violation. The hazardous condition was corrected during the inspection.    Badilla Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 315798678, citation number 1, item number 1 and was affirmed as a final order on November 28, 2011, with respect to a workplace located at 116 West Tioga Street, Tunkhannock, PA.
