29 CFR 1910.178(a)(5): The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered:   (a) On August 20, 2014, at the facility located at 5801 E Front St, Kansas city, MO., the employer did not ensure that the aftermarket Front-End Attachments used on the Forklifts for placement of extended loads, had been approved by the manufacturer and so identified on the data plate of the Forklift. Employees were exposed to serious struck-by injuries in the event the loads were not properly handled and calculated into the load capacity of the units.   Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.

29 CFR 1910.178(l)(4)(i): Refresher training, including an evaluation of the effectiveness of that training, shall be conducted as required by paragraph (l)(4)(ii) to ensure that the operator has the knowledge and skills needed to operate the powered industrial truck safely.      (a) On August 20, 2014, at the facility located at 5801 E Front St, Kansas city, MO., an employee operating a powered industrial forklift was involved in a loading accident when he directed an employee to sit on an elevated load in order to balance it during transport and off loading. As a result, the employee received minor struck-by injuries after falling off and then being struck by the falling load.      Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.

(a) On August 20, 2014, at the facility located at 5801 E Front St, Kansas city, MO., an employee was seriously injured while riding on an elevated loaded powered industrial truck in order to balance the load during transport and off loading. As a result, the employee received minor struck-by injuries after falling off and then being struck by the falling load. 29 CFR 1910.178(o)(1): Load(s) on powered industrial truck(s) were not stable or safely arranged:    (a) On August 20, 2014, at the facility located at 5801 E Front St, Kansas city, MO., employees were exposed to serious struck-by injuries, in that an over-sized load of plastic truck bed liners were placed on the forks of a powered industrial truck in an unstable and unsecured manner. An employee was riding the load in an attempt to balance and secure it during transport and off loading. As a result, the employee received serious struck-by injuries after falling off and then being struck by the falling load.      Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose. (Proof of training to address this issue)

29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition:  (a) On August 20, 2014, The employer did not ensure that the Toyota Powered Industrial Truck, SN#68372, Model 42-6FGCU18 used in the facility warehouse area was in a safe operating condition, in that the Emergency Parking Brake was inoperative. As result, employees were exposed to potential serious Struck-By injuries.  Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.
