29 CFR 1926.20(b)(1): The employer did not initiate and maintain such programs as may be necessary to comply with this part: The employer did not have an effective Temporary Traffic Control program or policies, including procedures for working safely in or near roadway construction, maintenance, and utility (work zone) operations that had not been developed, documented and utilized to promote highway safety to employees and provide warning and guidance needed for the reasonably safe, uniform, and efficient operation of all elements of the traffic stream. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s): There was no frequent and regular Temporary Traffic Control inspections being performed or maintained by a competent person to ensure the jobsite, materials and equipment such as traffic control channelization devices or system and work zone signs were being maintained and utilized in a safe condition.
