29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or another provision in paragraph (b) of this section which provides for an alternative fall protection measure:  (a)  Perez Roofing LLC, at 2910 Jade Court, Superior, CO: On and before 8/21/14, the employer did not ensure that each employee engaged in residential construction activities 6 feet or more above lower levels was protected by guardrail systems, safety net systems, personal fall arrest systems, or another provision in paragraph (b) of this section which provides for an alternative fall protection measure.  Three employees were re-roofing a two story home.  The employees were working upon the roof of the second story. This condition exposed the employees to a fall hazard of approximately twenty-one feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program enabling recognition of and appropriate protective procedures for fall hazards for each employee who might be exposed to fall hazards:  (a)Perez Roofing LLC, at 2910 Jade Court, Superior, CO: On and before 8/21/14, the employer did not provide a training program enabling recognition of and appropriate protective procedures for fall hazards for each employee who might be exposed to fall hazards. Three employees were re-roofing a two story home. The employees were working upon the roof of the second story. The employees had not been provided fall protection training.  This condition exposed the employees to a fall hazard of approximately twenty-one feet.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  (a)Perez Roofing LLC, at 2910 Jade Court, Superior, CO: On and before 8/21/14, the employer did not ensure portable ladders used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access.  Three employees were re-roofing a two story home.  The employees accessed the first story roof via an aluminum ladder.  The side rails of the ladder extended approximately 1.5 feet above the upper landing surface.  This condition exposed the employees to a fall hazard of approximately nine feet.

29 CFR 1926.1053(b)(8): Ladders placed in a location where they could be displaced by workplace activities or traffic, such as in passageways, doorways, or driveways, were not secured to prevent accidental displacement, nor was a barricade used to keep the activities or traffic away from the ladder:  (a)Perez Roofing LLC, at 2910 Jade Court, Superior, CO: On and before 8/21/14, the employer did not ensure that ladders placed in a location where they could be displaced by workplace activities were secured to prevent accidental displacement. Three employees were re-roofing a two story home.  The employees accessed the second story roof from the sloped first story roof via an aluminum ladder. This condition exposed the employees to a fall hazard of approximately twenty one feet.
