29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) On or about 08/21/14, at a trench/excavation construction site in front of home at 36 Fairbanks Ave., Tonawanda, NY: Employees engaged in construction work including installing sewer lines in trenches were not trained to recognize potential hazards on this type of jobsite, including but not limited to cave-in hazards, proper access to excavations, spoil pile hazards, and the need for personal protective equipment to protect them from various hazards. They also were not trained in the applicable OSHA regulations to control or eliminate these hazards. ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: a) On or about 08/21/14, in a trench/excavation in front of home at 36 Fairbanks Ave., Tonawanda, NY: An employee was in the trench which was 7 ft. 6 in. deep x approx. 2 ft. 3 in. wide at the bottom x 26 ft. long to install a new PVC sanitary sewer line to replace the existing clay tile sewer line. The north and south banks of the trench were vertical. An Ultra Shore Trench Shield, model # S48-84, was in the trench, but it was not the correct size in that it was only 4 ft. in height, while the trench was 7 ft. 6 in. deep. Additionally, the employee observed in the trench was in an area outside of the shield. The employee was not wearing a hardhat. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: a) On or about 08/21/14, in a trench/excavation in front of home at 36 Fairbanks Ave., Tonawanda, NY: An employee was in the trench which was 7 ft. 6 in. deep x approx. 2 ft. 3 in. wide at the bottom x 26 ft. long to install a new PVC sanitary sewer line to replace the existing clay tile sewer line. The north and south banks of the trench were vertical. Inspections were not made by a competent person prior to an employee entering the trench at the completed depth and as needed throughout the shift for evidence of a situation that could result in possible cave-ins , indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. NO ABATEMENT CERTIFICATION REQUIRED
