29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions hade been taken to ensure their safety:    At this job site, the competent person permitted employees to enter and work in a trench approximately 12 feet deep in which the protective system, a trench shield, had been removed. The employees entered the trench to remove formwork and worked in close proximity to a 12 foot tall vertical wall on the north side of the trench. The employees were exposed to cave-in hazards. Protective measures such as,  but not limited to, installing a trench shield or installing a hydraulic shoring system were not used.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that:    At this job site, a crew of three employees worked in a trench over 5 feet in depth without a protective system to prevent a cave-in. The employees worked in a trench 12 feet deep by 11 feet wide by 25 feet long which had been prepared with a 12 foot vertical wall on the north side of the trench.
