OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to molten metal eruptions and explosions during aluminum pour operation in locations that water was present. On or about June 16, 2014, an Alloy Associate was exposed to being struck by molten metal aluminum while pouring molten aluminum in a sow, causing second and third degree burns. The employer's process for cooling molds allowed water to accumulate into near by empty molds where molten aluminum was poured.

29 CFR 1910.132(d)(1)(i): When the employer had assessed the workplace hazards and determined that hazards were present, the employer did not select and/or use the types of personal protective equipment that would protect the affected employee from the hazards identified in the hazard assessment: a) On or about September 19, 2014, the employer's Personal Protective Equipment Program did not require employees cleaning the furnace tapping trough to wear protective leggings or spats to prevent molten aluminum entering an employee's boot.
