29 CFR 1910.132(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: a). On or about 8/29/14, on site, for drivers that handle cherry winter mix, Knocker Loose, and Consume Eco-Lizzer. They contain chemicals such as, but not limited to, Propylene Glycol and Fatty Ester. The employees are provided nitrile gloves however the employer does not enforce their use.

29 CFR 1910.22(a)(1): All places of employment, passageways, storerooms, and service rooms were not kept clean and orderly and in a sanitary condition: a). On or about 8/29/14, on site, for employees working in the vicinity of the bay curtains. The bay curtains are heavily soiled producing a dusty environment and exposing employees to an upper respiratory irritation.

29 CFR 1910.134(c)(2)(i): The employer did not provide respirator users with information contained in Appendix D to this section ("Information for employees using respirators when not required under this standard") when voluntary respirator use was permissible: a). On or about 8/29/14, on site, for drivers that work off site. The employer provided N95 respirators to employees in the event they are exposed to dusty conditions. The employer did not provide the Appendix D to the employees.
