29 CFR 1910.1200(h)(3)(iv): The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information: (Construction Reference: 1926.59) On or about August 27, 2014, at the above addressed jobsite, the employer did not provide adequate training or information regarding the hazards of chemicals, according to the Globally Harmonized System of Classification and Labeling of Chemicals with pictograms or representations, as a part of the new SDS and label format, to employees who perform patch work using products containing hazardous chemicals such as, but not limited to, Portland cement and silica. P & H Structural was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.1200(h)(1) which was contained in OSHA inspection number 959941, citation number 1, item number 3 and was affirmed as a final order on June 13, 2014, with respect to a workplace located at 800 1st Street, Miami Beach, FL 33139.

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer: (Construction Reference 1926.103) On or about August 27, 2014, at the above addressed jobsite, the employer provided 3M N95 filtering face piece respirators to employees who perform cement patch work, without providing the information in Appendix D to 29 CFR 1910.134.
