29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): a) On July 17, 2014, employees working in Building B at 3001 River Dr., Plover, WI, were not protected from falling while climbing more than 4 feet on the back section of the racking system located in Building B. The employer did not assess the workplace to determine if a fall protection system(s) would aid employees to do their work safely and to prevent falls potential(s) to the lower levels while employees moved unsecured stored product from damaged wood pallets located on the third level to the second level of the racking system.

29 CFR 1910.176(b): Storage was not secure. Storage of material shall not create a hazard. Bags, containers, bundles, etc., stored in tiers shall be stacked, blocked, interlocked and limited in height so that they are stable and secure against sliding or collapse. (a) The product stored on the cooler rack system and on the Building B rack system were not secured to prevent accidental collapse in that the wood pallets supporting the stored loads were bowed as result of the stored weight and had damaged and broken wood supports.
