29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person: At this job site, a personnel platform not designed by a qualified person mounted on a LULL forklift and was used to elevate employees to heights over 25 feet to a work area. The guardrail system exposed employees to falls from the platform in that: A. The mid-rail was installed at a height of 13 inches above the personnel platform. B. The top-rail was installed at a height of 33 inches above the personnel platform.

29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems. At this job site, employees were observed working without fall protection while installing decking panels on the roof of a new fabrication shop under construction. The employees were exposed to falls greater than 25 feet.
