29 CFR 1926.453(b)(2)(v):  A body belt (or harness) was not worn with a lanyard attached to the boom or basket when an employee was working from an aerial lift:      a) An employee was not wearing a fall protection harness (and) tied off to the aerial lift (JLG lift).  The employee drove the lift out into the street to get to the other jobsite gate; employee was exposed to 15 ft fall hazard and can be ejected if the lift is struck by vehicular traffic.       Location: 22 Bay Street, Brooklyn. N.Y.      On or about  7-17-2014        NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

29 CFR 1926.454(a): The employer did not have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:      a) Aerial lift training was not provided to employees operating several aerial lifts to construct a modular unit building.  Employees are exposed to fall hazard getting on and off aerial lifts on top of the 60 ft structure; may be exposed to vehicular traffic operating lifts in the street. 29 CFR 1926.760(a)(1):  Employee(s) engaged in steel erection activity who were on a walking/working surface with an unprotected side or edge more than 15 feet (4.6m) above a lower level were not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems:      a) Employees were not using a fall protection systems at the wall openings when working on the 60 ft modular unit building under construction.  Employees are exposed to fall hazard to 60 ft.       Location: 22 Bay Street, Brooklyn. N.Y. 29 CFR 1926.1053(b)(1):  When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least three feet above the upper landing surface; or, when such an extension is not possible because of the ladder's length, the ladder was not secured at its top to a rigid support that will not deflect, and a grasping device such as a grab rail was not provided:      a) A ladder being used by an employee extended only 2 feet above the upper edge of the modular unit and ladder was not secured.  Employee is exposed to 12 ft. fall hazard.      Location: 22 Bay Street, Brooklyn. N.Y.
