29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:   On or about August 29th 2014, at the above addressed jobsite, the employer did not provide the information contained in the appendix D to employees using a 3M N95 filtering face piece respirator while performing cutting operations in marble, granite, limestone and other stones.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace. Note:  The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.   On or about August 29th 2014, at the above addressed jobsite, the employer did not ensure that the employees were medically able to use a filtering facepiece respirator type 3M N95 while performing cutting operations in marble, granite, limestone and other stones.

29 CFR 1910.141(g)(2): Eating and drinking areas. No employee shall be allowed to consume food or beverages in a toilet room nor in any area exposed to a toxic material.   On or about August 29th 2014, at the above job-site, in the fabrication room, the employer did not ensure employees were not exposed to Silica dust while handling food and having a refrigerator and a microwave located in the fabrication room.

29 CFR 1910.1200(h)(3)(iv):   The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information:   On or about August 29th 2014, at the above addressed jobsite, the employer did not provide adequate training or information regarding the hazards of chemicals, according with the Globally Harmonized System of Classification and Labeling of Chemicals with pictograms or representations as a part of the new safety data sheets (SDS) and label format.
