Port of Long Beach, Berth TI-134, in water aft of M/V MSC SOLA: A Ports America foreman was exposed to a fall into the water or dock while riding the container spreader 60-70' in height out of the water on to the dock with three containers connected.

29 CFR 1918.105(b)(1): The employer did not require the wearing of PFDs for each employee engaged in work in which the employee might have fallen into the water. On August 18, 2014, Port of Long Beach, Berth TI-134, in water aft of M/V MSC SOLA: A Ports America foreman was exposed to a fall into the water while working within three feet of the unguarded edge of a intermodal which was floating in the water and the employer did not require him to use a PFD.
