OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard: a) Coil aisle on the west side of the warehouse - A vertical support of a loaded Interlake Metalux steel storage rack was approximately six inches out-of-plumb at its bottom due to being struck by a forklift. On or about 9/4/14. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): a) Warehouse - Each employee who operated the facilitys propane forklifts including, but not limited to one Caterpillar, one Komatsu and three Nissan sit down forklifts, were not trained per the requirements of the standard. On or about 9/4/14. Abatement Note: Forklift operator training consists of a combination of formal instruction (e.g., lecture, discussion, interactive computer based training, video tape, written material, etc.), practical training (demonstration performed by the trainer and practical exercises performed by the trainee), and an evaluation of the operators performance in the workplace. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
