29 CFR 1910.106(e)(6)(i): Adequate precautions were not taken to prevent the ignition of flammable vapors: On or about September 4, 2014, at the jobsite located at the North and West side of the property, the employer did not take adequate precautions to prevent a highly flammable liquid and vapor from being exposed to radiant heat. Employees working around and about portable tanks of Propylene oxide are exposed to explosion hazards associated with the radiant heat applied to the tanks from the direct sunlight being received by the way in which they are stored.

29 CFR 1910.38(b): An emergency action plan was not in writing, kept in the workplace, and available to employees for review: On or about September 4, 2014, at the facility, the employer did not have a written emergency action plan which was accessible and readily available for review to employees entering confined spaces and engaged in dispensing and handling flammables such as Methanol, Ethanol and Propylene oxide and Propylene glycol which is a combustible.
