OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:     a) For employees working at 1221 SW Eucalyptus Avenue in Arcadia, as observed on or about August 26, 2014, and at times prior, the employer exposed employees to struck-by and crush hazards in that employees were allowed to operate the Hyster forklift without a seatbelt installed.

Employees were using employer supplied respirators for voluntary use to spray paint/sealant. Employees were not provided with the information contained in Appendix D in that the employees did not read and heed all instructions provided by the manufacturer and did not know what atmosphere the cartridge in use was manufactured to protect against.

Employees were using a respirator to spray sealant on the new sheds. Employer did not establish a written program that contained a medical certification of employees using the respirators and the proper storage of the respirator.
