29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: Located at a family house under new construction on the Barona Reservation, the employer failed to provide the following: (a) Protective gloves were while using a trowel to smooth out portland cement, exposing employees to the hazard of contacting the cement as described in the material safety sheet. (b) Eye protection while using a trowel to smooth portland cement and while handling the chute of a concrete truck that poured portland cement into the formwork for the sidewalk as described in the material safety sheet exposing employees to the hazard of portland cement contact.

29 CFR 1926.303(c)(3): All other portable abrasive wheels used for external grinding, were not provided with safety guards (protection hoods) meeting the requirements of paragraph (c)(5) of this section: Located at a family house under new construction on the Barona Reservation, the employer failed to provide guarding protection for a 4.5-inch Drill Master right angle grinder with a 4 inch diameter composite wheel, exposing employees to struck-by and laceration hazards from flying materials.

29 CFR 1926.404(b)(1)(i): General. The employer shall use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites. These requirements are in addition to any other requirements for equipment grounding conductors. Located at a family house under new construction on the Barona Reservation, the employer failed to provide ground fault circuit interrupters for electrical equipment exposing the employee to the hazards of electrical shock.
