29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a- Old York Road Across From Compton Drive, East Windsor NJ: On or about 09/03/14, company employees were exposed to cave in and crushing hazards when working in an excavation (cut in soil Type B) that was not adequately sloped, benched, shored, or shielded nor were they provided with safe egress. These employees had not received excavation safety training from the company at the time of the worksite inspection. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): a- Old York Road Across From Compton Drive, East Windsor NJ: On or about 09/03/14, company employees were exposed to cave in and crushing hazards when working in an excavation (approximately 6 feet 7 inches deep and cut in Soil Type B) that contained sidewalls that were not adequately sloped, benched, shored, or shielded to protect them. Riverfront Recycling & Aggregate, LLC. was previously cited for a Serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 909207, citation number 1, item number 1b and was affirmed as a final order on 08/16/13, with respect to a workplace located at Laurel Green Project, Arc Road, Mt. Laurel, NJ.
