29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years: a) Facility Wide - On or about September 5, 2014, the employer failed to ensure that operators of the stand up and sit down forklifts were evaluated at least once every three years. In accordance with 29CFR 1903.19(d), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: a) Shop Area - On or about September 5, 2014, the Fuji lathe (s/n - 6394) was operated without being equipped with a chuck and chip guard to protect employees from hazards, such as the rotating chuck, point of operation, and flying chips. b) Shop Area - On or about September 5, 2014, the Milwaukee milling machine was operated without machine guarding to protect employees from hazards, such as those created by point of operation, ingoing nip points, and rotating parts. In accordance with 29CFR 1903.19(d), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.
