29 CFR 1910.1200(h)(1): Employees were not provided effective information and training as specified in 29 CFR 1910.1200(h)(2) and (h)(3) on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (a) An employee who was exposed to hazardous chemicals while performing welding and oxyacetylene cutting had not been provided information and training concerning the following: * Information concerning the requirements of the hazard communication standard * Information concerning operations in their work area where hazardous chemicals were present * Information regarding the location and availability of the written hazard communication program, including the required list of hazardous chemicals, and material safety data sheets * Training on the physical and health hazards of chemicals * Training on the details of the hazard communication program developed by the employer, including an explanation of the labels received on shipped containers and the workplace labeling system used by the employer, the material safety data sheet/safety data sheet, including the order of information and how employees can obtain and use this hazard information ABATEMENT CERTIFICATION IS REQUIRED

29 CFR 1915.73(d): When employees were exposed to unguarded edges of decks, platforms, flats, or similar flat surfaces, more than 5 feet above a solid surface, the edges were not guarded by adequate guardrails meeting the requirements of 29 CFR 1915.71(j)(1) and (2): (a) Two unguarded 3.5-foot areas at the top on either side of the gangway (starboard side) onboard a Maybank Barge that was under construction were not provided with guardrails. Lack of appropriate guardrails could result in a fall of approximately 20 feet to the ground below. ABATEMENT CERTIFICATION IS REQUIRED
