29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form.        a) On or about September 10, 2014, the employer failed to identify the respiratory hazard of silica dust generated form the cutting concrete containing silica. The evaluation should have included a reasonable estimate of employee exposures to the respiratory hazard and an identification of the contaminant's chemical state and physical form.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met.        a) On or about September 10, 2014, Arrow Concrete Cutting Inc. failed to develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met. Employees of Arrow Concrete Cutting Inc., operating a concrete saw, were exposed to silica dust without having been trained on the hazards associated with silica exposure.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area.        a) On our about September 10, 2014, Arrow Concrete Cutting Inc. Failed to provide effective information and training on hazardous chemical in their work area in that employees were exposed to silica dust while cutting concrete. Employees were not trained on the hazards associated with silica exposure such as but not limited to; silicosis, and tuberculosis.
