29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service: a) Workplace, 295 Skidmore Rd., Deer Park, NY- Employees operated a Hyster diesel forklift, model and serial number on nameplate were illegible, without examining the vehicle prior to use; on or about 9/10/14. b) Workplace, 295 Skidmore Rd., Deer Park, NY- Employees operated a Hyster Diesel forklift, 5,200lb capacity, model and serial number on nameplate were illegible, without examining the vehicle prior to use; on or about 9/10/14. c) Workplace, 295 Skidmore Rd., Deer Park, NY- Employees operated a Komatsu Diesel forklift, 8,200lb capacity, model and serial number on nameplate were illegible, without examining the vehicle prior to use; on or about 9/10/14. d) Workplace, 295 Skidmore Rd., Deer Park, NY- Employees operated a Doosan Diesel forklift, 4,900lb capacity, model #305-3, serial #K-02791, without examining the vehicle prior to use; on or about 9/10/14. 29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): a) Workplace, 295 Skidmore Rd., Deer Park, NY- The employer authorized employees to operate forklifts, such as but not limited to a Hyster diesel powered lift, model and serial number on nameplate was illegible; a Hyster 5,200lb diesel powered lift, model and serial number on nameplate was illegible; a Komatsu 8,200lb capacity diesel powered lift, model and serial number on nameplate was illegible; and a Doosan 4,900 capacity diesel powered lift, Model #305-3, serial number K-02791, without providing powered industrial equipment training that included a combination of formal instruction, practical training and a performance evaluation prior to operating the forklift when the employee was initially assigned to operate the equipment; on or about 9/10/14. Note: In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
