Boxes, garbage bags, waste and loose merchandise cluttered the basement storage area.

29 CFR 1910.37(a)(4): Safeguard(s) designed to protect employees during an emergency (e.g., sprinkler systems, alarm systems, fire doors, exit lighting), were not in proper working order at all times: Located at 1150 6th Ave, New York, NY 10036 On or about 9/12/2014 a) The fire door exit lights were not illuminated in the basement stock room area to provide direction for escape during a fire or emergency. The configuration of shelving and the layout of the basement the three exits out of the basement cannot be seen from every location, there is no natural light into the basement and the exits are not visible without the emergency lighting. One Emergency Exit did not have any signage to indicate it was an emergency exit.

On or about 9/12/2014 a) Merchandise Boxes and other stored inventory in the 2nd floor stockroom were not stacked in a safe manner to prevent leaning, sliding or collapse. Boxes were stacked one atop the other approximately 10-12 feet high, positioned unevenly upon each other and leaning to the side. The stacked tiers of merchandise have collapsed in the past.

29 CFR 1910.37(a)(3): Exit route(s) were not kept free and unobstructed: Located: 1150 6th Ave New York, NY Basement stockroom On or about 3/11/2013 a) West Exit route to the public way was obstructed in the basement store room. The exit route beyond the exit door leading onto the hallway and up to the public way was obstructed by materials such as plastic crates and other items. b) Boxes, crates and other materials were stored in the aisles and passageways of the exit route leading to the South exit door. c). East exit route was blocked with empty boxes and garbage bags. REPEAT STATEMENT Duane Reade was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.37(a)(3), which was contained in OSHA inspection number 906432, citation number 2, item number 1 and was affirmed as a final order on 8/7/2013, with respect to a workplace located at 598 Broadway, New York, NY 10012.
