29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation be sloped at an angle not steeper than one and one half horizontal to one vertical, unless the employer uses on of the other options listed in 29 CFR 1926.652:     a)    Brewers Bridge site, West side under power lines:    Employees working in the bottom of the approximate 6-6 1/2 foot deep improperly benched excavation, on or about 09/10/14.     NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:    a)    Brewers Bridge site, West side under power lines:    The approximate 7 foot deep, improperly benched excavation employees worked in, had not been inspected by a "competent person" prior to and throughout the day, on or about 09/10/14.    NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.    Mazzara Trucking and Excavation Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(k)(1), which was contained in OSHA inspection number 329942, citation number 1, item number 2 and was affirmed as a final order on 07/31/12, with respect to a workplace located at Pelham Rd at Willow Ridge, Marlton, NJ 08053.
