29 CFR 1926.451(g)(1)(vi): Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity).  On or about September 10, 2014, employees were exposed to fall hazards of approximately 37 feet when a section of the scaffold did not have any guardrails in place while materials were being received from the ground below.

29 CFR 1926.451(g)(4)(iii): When midrails, screens, mesh, intermediate vertical members, solid panels, or equivalent structural members are used, they were not installed between the top edge of the guardrail system and the scaffold platform.  On or about September 10, 2014, employees were exposed to fall hazards of approximately 37 feet when no midlrail was installed on the section of the scaffold where materials were received from employees on the ground below.  A single board was used as a toprail to facilitate removing the guardrail when material was being received.
