29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: On or about September 11, 2014, employees were exposed to the hazards of a cave-in while working in an excavation due to the failure to provide inspection of the excavation by a competent person.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(ii) in that for an excavation less than five feet in depth the ground was not examined by a competent person to determine if there was potential for a cave-in. On or about September 11, 2014, employees working in an excavation under a residential trailer were exposed to the hazards of a potential cave-in.
