29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition:  (a) On September 16, 2014, The employer did not ensure that the Clark-GCX 25 Powered Industrial Truck, SN#GX230 -0039-8805 used in the facility warehouse was in a safe operating condition, in that the Emergency Parking Brake was inoperative. As result, employees were exposed to potential serious Struck-By injuries.  Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.
