29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) Site -  On or about 09/02/14 and at times prior thereto employees were installing the second floor joists  and were standing/walking on the top plate at 9.0 ft. above ground level without fall protection equipment.   (Inspection at 5545 Dooley Way, Shiloh Woods Subdivision Lot #108, Cumming, GA 30340).  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  a) Site -  On or about 09/02/14 and at times prior thereto employees were installing the second floor joists and climbed onto the top plate by use of a 6 ft. step ladder which did not extend 3.0 ft. above the top plate. (Gap between top step of ladder and top plate: 42 in.).    (Inspection at 5545 Dooley Way, Shiloh Woods Subdivision Lot #108, Cumming, GA 30340).  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step:  a) Site -  On or about 09/02/14 and at times prior thereto employees were installing the second floor joists and climbed onto the top plate by use of a 6 ft. step ladder which did not extend 3.0 ft. above the top plate.  Employees stood on the top step of the ladder to reach the top plate of the wall situated at a 10 ft. elevation from ground level. (The gap between the top step of the ladder and top plate of the wall was 42 in.).    (Inspection at 5545 Dooley Way, Shiloh Woods Subdivision Lot #108, Cumming, GA 30340).  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.1060(a)(1): 1926.1060(a)(1):  The employer did not ensure that each employee was trained by a competent person which would enable each employee to recognize hazards related to ladders and stairs, and the procedures to follow to minimize those hazards.  a) Site -  On or about 09/02/14 and at times prior thereto employees were installing the second floor joists and climbed onto the top plate by use of a 6 ft. step ladder which did not extend 3.0 ft. above the top plate.  Employees stood on the top step of the ladder to reach the top plate of the wall situated at a 10 ft. elevation from ground level. The employer did not ensure that employees were trained by a competent person in the safe use of ladders and in the recognition of the associated hazards.    (Inspection at 5545 Dooley Way, Shiloh Woods Subdivision Lot #108, Cumming, GA 30340).
