OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being caught between, struck-by, or crushed-by a Ditch Witch 410 SX that was found to have an operator presence sensing switch and parking brake that were inoperable. Ditch Witch Model 410SXD, Serial 4Y0337 had an operator presence sensing switch and parking brakes that were not operational. Ditch Witch Model 410SXD, Serial 4X8307 had an operator presence sensing switch and parking brakes that were not operational.
