29 CFR 1903.19(c)(1): Within ten calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section:  a.  The employer has failed to submit abatement certification within ten days of the abatement date, October 11, 2014, for a violation of 29 CFR 1926.451(g)(4)(ii), issued as citation 1, item 2, and described as follows:  At the worksite where employees were installing an exterior insulation and finishing system to the front of the building using a scaffold, the top guardrails were not installed between 38 inches and 45 inches above the platform surface, thereby exposing employees to a 20 foot fall hazard.  b.  The employer has failed to submit abatement certification within ten days of the abatement date, October 11, 2014, for a violation of 29 CFR 1926.451(g)(4)(iv), issued as citation 1, item 3, and described as follows:  At the worksite where employees were installing an exterior insulation and finishing system to the front of the building using a scaffold, midrails were not installed at a height approximately midway between the top edge of the guardrail system and the platform surface, thereby exposing employees to a 20 foot fall hazard.

29 CFR 1903.19(d)(1): The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required:  a.  The employer has failed to submit abatement certification and documentation within ten days of the abatement date, October 11, 2014, for a violation of 29 CFR 1926.451(g)(1)(vii), issued as citation 1, item 1, and described as follows:  On the top of the scaffold where an employee was applying mesh to the building, the employee was not protected from falls, thereby being exposed to a 20 foot fall hazard.   b.  The employer has failed to submit abatement certification and documentation within ten days of the abatement date, October 11, 2014, for a violation of 29 CFR 1926.451(e)(1), issued as citation 2, item 1, and described as follows:  At the worksite where employees were installing an exterior insulation and finishing system to the front of the building using a scaffold, the employees climbed the scaffold cross braces to gain access to the second and third levels of the scaffold, thereby being exposed to a 20 foot fall hazard.     Visintine Construction was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 98888, citation number 1, item number 1 and was affirmed as a final order on January 4, 2012, with respect to a workplace located at 5855 West Central Avenue, Toledo, Ohio.

29 CFR 1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  a. On the top of the scaffold where an employee was applying mesh to the building, the employee was not protected from falls, thereby being exposed to a 20 foot fall hazard.

29 CFR 1926.451(g)(4)(ii): The top edge height of toprails or equivalent member on supported scaffolds manufactured or placed in service after January 1, 2000 shall be installed between 38 inches (0.97 m) and 45 inches (1.2 m) above the platform surface. The top edge height on supported scaffolds manufactured and placed in service before January 1, 2000, and on all suspended scaffolds where both a guardrail and a personal fall arrest system are required shall be between 36 inches (0.9 m) and 45 inches (1.2 m). When conditions warrant, the height of the top edge may exceed the 45-inch height, provided the guardrail system meets all other criteria of paragraph (g)(4).   a. At the worksite where employees were installing an exterior insulation and finishing system to the front of the building using a scaffold, the top guardrails were not installed between 38 inches and 45 inches above the platform surface, thereby exposing employees to a 20 foot fall hazard.

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.  a. At the worksite where employees were installing an exterior insulation and finishing system to the front of the building using a scaffold, the employees climbed the scaffold cross braces to gain access to the 2nd and 3rd levels of the scaffold, thereby being exposed to a 20 foot fall hazard.   Visintine Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(e)(1), which was contained in OSHA inspection number 98888, citation number 1, item number 1 and was affirmed as a final order on 01/04/2012, with respect to a workplace located at 5855 West Central Avenue, Toledo, Ohio, 43615.
