On or about September 15, 2014, the employer failed to protect employees performing roofing work, on a flat roof with a fall of approximately 25 feet to the lower level, with fall protection described in 29 CFR 1926.501(b)(10).

29 CFR 1926.502(b)(1): The top edge height of the top rails, or equivalent guardrail system members, was not 42 inches (1.1 m) plus or minus 3 inches (8 cm) above the walking/working level:    On or about September 15, 2014, the employer failed to provide a top rail that was 42 inches, plus or minus 3 inches, above the walking/working level for the railing leading to the debris chute.  The employer had installed a top rail that was 30 inches high.

29 CFR 1926.502(b)(2): Midrails, screens, mesh, intermediate vertical members, or equivalent intermediate structure members were not installed between the top edge of the guardrail system and the walking/working surface when there was no wall or parapet wall at least 21 inches (53 cm) high.    On or about September 15, 2014, the employer failed to provide a mid-rail or equivalent protection for the guardrails surrounding the debris chute.

29 CFR 1926.852(f):  A securely attached toeboard or bumper, not less than 4 inches thick and 6 inches high, was not provided at each chute opening where material was dumped from mechanical equipment or wheelbarrows.      On or about September 15, 2014, the employer failed to attach an adequate toeboard or bumper to the top of the chute which had debris dumped into it by wheelbarrows.  The employer was using a piece of wood that was 1.5 inches by 3.5 inches.
