29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:      a) On or about October 8, 2014 at the above addressed job site, an employee operating a pneumatic nail gun was exposed to noise dose of 80.8% or an equivalent of 88.4 dBA which was capable of causing permanent hearing loss.  Monitoring was performed for 342 minute sampling time and zero exposure for the remaining 138 minutes of the 8 hour shift.    b) On or about October 8, 2014 at the above addressed job site, an employee operating a Dewalt Table Saw was exposed to noise dose of 71.6% or an equivalent of 87.5 dBA which was capable of causing permanent hearing loss.  Monitoring was performed for 353 minute sampling time and zero exposure for the remaining 127 minutes of the 8 hour shift.
