OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and struck-by hazards while using an automotive lift:    (a)  On or about September 19, 2014, and at times prior the employer did not ensure that employees         were safe from crushing and struck-by hazards in that the following lifts were noted with deficiencies:        (1)  Benwil lift, model GPO-7, serial #B89T0003, did not have the locking mechanism locked             into place while the lift was raised and in use.        (2)  Benwil lift, model SPOA10N5G0 Serial #CNP14D0075, did not have the locking mechanism locked             into place while the lift was raised and in use.        (3)  Benwil lift, model SPOA10N5G0 Serial #CNP14F0015, did not have the locking mechanism locked             into place while the lift was raised and in use.        (4)  Benwil lift, Model GPO-7, serial #B8809054, was available for use and not taken out of service.  The lift exhibited            defects such as, but not limited to, the raising and lowering lever was broken and the lock could not engage            without manual intervention and other components (two springs) were not correctly affixed.          (5)  The employer did not document that all lift users were trained to use the lifts in that several rotary lifts were not              lowered onto locks while in use. 29 CFR 1910.1200(f)(5)(i): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the identity of the hazardous chemical(s) contained therein:    (a) On or about January 3, 2013, the employer exposed employees in the automotive area to chemical hazards due to missing or inadequate labels on multiple containers containing chemicals used for automobile cleaning and repair, including two tanks of oil. 29 CFR 1910.23(e)(7)(iii): The construction of floor opening covers may be of any material that meets the strength requirements. Covers projecting not more than 1 inch above the floor level may be used providing all edges are chamfered to an angle with the horizontal of not over 30 degrees. All hinges, handles, bolts, or other parts shall set flush with the floor or cover surface.  (a)  On or about September 19, 2014, the employer exposed employees to trip and fall hazards due to a portion of the drainage grates, running along the length of the automotive bay area which were bent and raised approximately 1.5 inches about ground, presenting uneven edges.   Abatement Note:  Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
