29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:  a) On or about September 5, 2014  - Jobsite at Section 45 Farmville Avenue and 80th Street Middle Village, NY 11379   Management did not provide a competent person able to identify that Excavations in previously disturbed soil up to 8-feet in depth requires proper sloping at 1:1 or a shoring system engineered or equal to Subpart P shoring tables.   WRITTEN ABATEMENT CERTIFICATION IS REQUIRED.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the sloping or benching system design was not followed:     a) On or about September 5, 2014  - Jobsite at Section 45 Farmville Avenue and 80th Street Middle Village, NY 11379     Management permitted employees to use timber shoring 1.25-inches thick, 6-inches wide, laid as wails should be and 2-inch diameter steel bars with rope tie backs, as uprights that did meet the minimum criteria for timber shoring at depths of 5-feet to 8-feet.   Employees did not understand the use of a 1:1 slope as a protective system.
