29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: U.S.C.G. Capehart Housing, North Bend Oregon- (a) Employees were observed installing roofing materials and were working outside the warning line area on the low-slope roof and were exposed to fall hazards of 17' 3" to the ground below.

29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill. U.S.C.G. Housing, North Bend Oregon- (a) The designated competent person was not performing the assigned duties of the safety monitor, exposing himself and other workers to falls from the roof. Assigned duties included monitoring employees working in and around the safety warning line system and ensuring the warning line system was maintained. (b) In the absence of the Safety Monitor workers continued to perform roofing work activities.
