OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crush hazards while operating a forklift without a seatbelt:  a) Warehouse and yard areas; On or about September 29, 2014 and at times prior the employer exposed employees to crush hazards in that employees were allowed to operate a forklift with no seatbelt.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:  a) In the battery charging area; on September 29, 2014 and times prior the employer did not provide a means for employees quickly drench or flush the eyes and body if exposed to injurious corrosive materials. The water source available was blocked by boxes of recyclable materials.

29 CFR 1910.305(d)(2): Panelboards shall be mounted in cabinets, cutout boxes, or enclosures designed for the purpose and shall be dead front.  a) West wall above battery charging area; on or about September 29, 2014 and times prior the employer exposed his employees to electrical shock and explosion hazards by not installing a dead front on an open panelboard.
